Approval of CNSM’s compliance with the provisions of the EBA Guide on appropriate subsets of sectoral exposures to which the competent or designated authorities may apply a systemic risk buffer in accordance with Article 133 (5) (f) of Directive 2013/36 / EU – EBA / GL / 2020/13

In its meeting of 30 March 2021, held by written procedure, the General Board of the NCMO approved to incorporate the Guidelines of the European Banking Authority on the appropriate subsets of sectoral exposures to which competent or designated authorities may apply a systemic risk buffer in accordance with  Article 133(5)(f) of Directive 2013/36/EU – EBA/GL/2020/13, in the sense of using them to set and regularly reassess at a national level the systemic risk buffer as a macroprudential tool in accordance with the provisions of Articles  25 – 34 of the NCMO Regulation no.2/2017 on the methodology and procedure used for setting capital buffers and the scope of these instruments, with subsequent amendments and completions.

The EBA/GL/2020/13 contains guidelines issued pursuant to Article 16 of Regulation (EU) No 1093/2010 establishing a European Supervisory Authority (European Banking Authority) on criteria for the identification of subsets of sectoral exposures to which competent or designated authorities may apply a systemic risk buffer and for assessing the systemic relevance of the risks, as well as a set of principles regarding the interaction of the sectoral SyRB with other macroprudential measures and reciprocity.
